Article 1 – Definitions

• Withdrawal Period: The period within which the consumer can exercise their Right of Withdrawal.
• Consumer: The natural person who is acting for purposes which are outside their trade, business, craft, or profession and who enters into a Distance Agreement with the Entrepreneur.
• Day: Calendar day.
• Long-Term Transaction: A Distance Agreement relating to a series of products and/or services, the delivery and/or purchase obligations of which are spread over time.
• Durable Medium: Any instrument which enables the Consumer or Entrepreneur to store information addressed personally to them in a way accessible for future reference for a period adequate for the purpose of the information, and which allows the unchanged reproduction of the stored information.
• Right of Withdrawal: The option for the Consumer to terminate the Distance Agreement within the Withdrawal Period.
• Entrepreneur: The natural or legal person offering products and/or services to Consumers from a distance via Raresparesshop.com
• Distance Agreement: An agreement concluded between the Entrepreneur and the Consumer under an organized distance sales system, using exclusively one or more techniques for distance communication up to and including the time at which the agreement is concluded.
• Model Withdrawal Form: The European standard form for withdrawal made available to the Consumer to terminate the agreement.

Article 3 – Applicability

1. These General Terms and Conditions apply to every offer made by the Entrepreneur on Raresparesshop.com and to every Distance Agreement concluded between the Entrepreneur and the Consumer.
2. Prior to the conclusion of a Distance Agreement, the text of these General Terms and Conditions will be made available to the Consumer. If this is not reasonably possible, it will be indicated before the agreement is concluded where the terms can be inspected and that they will be sent free of charge upon request.
3. If the agreement is concluded electronically, the text of these conditions can be made available electronically in such a way that the Consumer can easily store them on a Durable Medium.
4. If specific product or service conditions apply in addition to these general terms, the most favorable provision for the Consumer will apply in the event of conflicting terms.

Article 4 – The Offer

1. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.
2. The offer contains a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to enable a proper assessment by the Consumer.
3. Images used are true representations of the products/services. Obvious errors or mistakes in the offer do not bind the Entrepreneur.
4. All consumer prices stated in offers are inclusive of VAT and all mandatory taxes or charges.

Article 5 – The Agreement

1. The agreement is concluded at the moment the Consumer accepts the offer on Raresparesshop.com and fulfills the conditions set out therein.
2. If the Consumer accepts the offer electronically, the Entrepreneur will immediately confirm receipt of acceptance electronically. Until this receipt is confirmed, the Consumer may rescind the agreement.
3. The Entrepreneur takes appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment.
4. The Entrepreneur will send the Consumer the following information in writing or on a Durable Medium, at the latest upon delivery of the product or service:
   • The contact address for filing complaints;
   • The conditions and procedures for exercising the Right of Withdrawal, or a clear statement regarding its exclusion;
   • Information on guarantees and post-sales service;
   • The standard Model Withdrawal Form.

Article 6 – Right of Withdrawal

For Products:

1. The Consumer can cancel a contract relating to the purchase of a product during a cooling-off period of 14 days without giving reasons.
2. The cooling-off period commences on the day after the Consumer, or a third party designated by the Consumer (other than the carrier), receives the product.
3. During the cooling-off period, the Consumer shall handle the product and packaging with care. The Consumer shall only unpack or use the product as far as necessary to establish the nature, characteristics, and functioning of the product.

For Services:

4. The Consumer can cancel a service agreement within 14 days without giving reasons, starting on the day the agreement is concluded.

Article 7 – Obligations and Return Shipping Costs in Case of Withdrawal

1. If the Consumer exercises their Right of Withdrawal, they must inform the Entrepreneur within the 14-day cooling-off period using the Model Withdrawal Form or another unambiguous written statement.
2. The Consumer shall return the product as soon as possible, but within 14 days of giving notification of withdrawal.
3. COSTS OF RETURN: The Consumer bears the direct costs of returning the product(s) to the Entrepreneur. The Consumer is fully responsible for organizing return transport and paying all associated shipping, postal, and customs/import charges (if returning from outside the EU), unless explicitly agreed otherwise in writing.
4. The Entrepreneur shall reimburse all payments received from the Consumer for the returned product, including the initial standard delivery costs paid by the Consumer, without delay and within 14 days from the day on which the Entrepreneur is informed of the decision to withdraw.
5. The Entrepreneur may withhold reimbursement until they have received the goods back or until the Consumer has supplied proof of having sent back the goods, whichever is earliest.
6. The Entrepreneur will use the same payment method for reimbursement as used by the Consumer, unless agreed otherwise.

Article 8 – Exclusion of the Right of Withdrawal

• Custom-made products according to Consumer specifications or clearly personalized items;
• Perishable goods or products with a limited shelf life;
• Sealed products which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
• Sealed audio, video recordings, or computer software whose seal was broken after delivery;
• Newspapers, periodicals, or magazines (excluding subscriptions);
• Service contracts after full performance of the service, if performance began with the Consumer’s explicit prior consent and acknowledgement of losing the right to withdraw upon full performance.

Article 9 – Pricing

1. During the validity period stated in the offer, prices will not be increased, except for changes resulting from statutory regulations or VAT adjustments.
2. Prices stated in consumer offers include statutory VAT.

Article 10 – Conformity and Guarantees

1. The Entrepreneur warrants that the products and/or services comply with the agreement, the specifications stated in the offer on raresparesshop, reasonable requirements of soundness and usability, and applicable statutory provisions.
2. Any extra guarantee provided by the Entrepreneur, manufacturer, or importer shall not affect the statutory legal rights and claims the Consumer holds against the Entrepreneur under applicable national laws.

Article 11 – Delivery and Execution

1. The Entrepreneur will take the utmost care when receiving and executing orders.
2. Delivery will take place at the address provided by the Consumer.
3. Orders will be executed promptly and within 30 days at the latest, unless a different delivery period was explicitly agreed upon. If delivery is delayed, the Consumer will be notified as soon as possible. In such cases, the Consumer has the right to terminate the agreement free of charge and is entitled to a full refund.
4. In the event of termination under paragraph 3, the Entrepreneur will refund all paid amounts within 14 days.
5. The risk of damage and/or loss of products rests with the Entrepreneur until the moment of delivery to the Consumer or a representative designated by the Consumer. In the event of damaged or missing items upon delivery, the Consumer is kindly requested to inform the Entrepreneur as soon as reasonably possible.

Article 12 – Long-Term Transactions: Duration, Termination, and Renewal

1. Termination: The Consumer may terminate an agreement entered into for an indefinite period or a fixed period at any time, subject to a maximum notice period of one month.
2. Renewal: Agreements entered into for a fixed period may not be automatically extended for a fixed duration. Automatic extension into an agreement of indefinite duration is allowed provided the Consumer retains the right to terminate at any time with a notice period of maximum one month.

Article 13 – Payments

1. Unless otherwise agreed, amounts owed by the Consumer must be paid within 14 days after the start of the cooling-off period.
2. In general terms and conditions, a Consumer may never be obliged to make an advance payment exceeding 50% of the order value. When an advance payment is stipulated, the Consumer cannot assert rights regarding execution of the order until the stipulated advance payment has been made.
3. The Consumer is obligated to notify the Entrepreneur immediately of any inaccuracies in provided payment details.

Article 14 – Complaints Procedure

1. Complaints regarding the execution of the agreement must be submitted fully and clearly to the Entrepreneur within a reasonable time after the Consumer has detected the defects.
2. Complaints submitted will be answered within 14 days from the date of receipt. If a complaint requires a longer processing time, the Entrepreneur will acknowledge receipt within 14 days and indicate when a more detailed response can be expected.

Article 15 – Disputes

1. Agreements between the Entrepreneur and the Consumer to which these General Terms and Conditions apply are governed exclusively by Dutch Law, without prejudice to mandatory rights Consumers enjoy under their local law.
2. Consumers may submit disputes to Stichting WebwinkelKeur for free mediation. If unresolved, disputes can be submitted to an authorized dispute resolution body or court.
3. European consumers can also submit complaints via the European Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr.
